2. Definitions

• Tavern: a community space created by a user on the Service, including its halls, categories, forums, events, rules, roles, emoji, stickers, settings, and members.
• Hall: a text, voice, video, forum, or announcement room inside a Tavern.
• Tavern Owner: the account that creates a Tavern or later holds ownership of it.
• Moderator: any member a Tavern Owner gives administrative or moderation permissions to, whatever the role is called.
• Member: any account that has joined a Tavern.
• Wonder: a user-created game, hangout, world, or experience published on the platform, including everything inside it.
• Creator: a user who builds, publishes, or sells a Wonder, asset, item, or other content through the Service, including through Wonders Studio.
• Bot: an application, integration, webhook, or automated account that connects to the Service through our developer tools.
• User Content: anything a user creates, uploads, shares, or publishes on the Service, including Taverns, Halls, messages, posts, profiles, images, audio, video, emoji, stickers, Wonders, assets, Bots, and their settings.

3. Eligibility and Age

You must be at least 13 years old to use the Service, and at least the minimum age required by the laws of your country or region. The Service is not designed for, or directed to, children under 13.

If you are under the age of legal majority where you live, you may use the Service only if your parent or legal guardian has reviewed these Terms and agrees to them on your behalf. A parent or legal guardian who allows a minor to use the Service is responsible for all use of the Service by that minor.

Some features, including Mature Content, are available only to users who have verified that they are adults. You may not attempt to bypass an age or maturity control.

4. Your Account

You may need to create an account to access certain features.

You agree to:

• provide accurate and current account information;
• keep your login credentials secure and not share your account;
• be responsible for all activity under your account, including activity by anyone you allow to use it;
• notify us promptly if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms, harm the Service, or create safety, legal, or operational risk.

5. Limited License

Subject to these Terms, MEKASMITH grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, and, where a feature is designed for it, to run a community, publish a Wonder, or operate a Bot.

You may not:

• copy, modify, distribute, sell, lease, or commercially exploit the Service except as expressly authorized;
• reverse engineer, decompile, or attempt to extract source code, except where the law prohibits us from restricting that activity;
• access the Service by automated means other than our published developer tools, or scrape, harvest, or collect user information;
• interfere with the Service, its servers, its security, or other users.

6. User Content

You are solely responsible for the User Content you create, upload, share, or publish, and for the consequences of doing so. You must have all rights necessary to submit your User Content and to grant the rights described in these Terms.

We do not pre-screen User Content and we have no obligation to monitor it, although we may review, filter, or remove it as described in Section 12. Nothing on the Service is published, endorsed, or verified by MEKASMITH unless we expressly say so.

7. Taverns: Owner and Moderator Responsibility

When you create a Tavern you become its Tavern Owner. A Tavern is your community, run by you and the Moderators you appoint. MEKASMITH provides the hosting, software, and platform tools. We do not run, supervise, or control your Tavern, and we are not a party to any relationship between you and your Members.

As a Tavern Owner you are responsible for your Tavern, and Moderators are responsible for the actions they take in it. That includes:

• the rules, roles, permissions, invitations, discovery listing, and settings you choose, and the Moderators you appoint;
• actively moderating your Tavern so that its content and conduct comply with these Terms, the Community Guidelines, and applicable law, and removing violating content or Members promptly when you become aware of them;
• rating your Tavern and its content honestly, including marking mature content, and keeping restricted content away from Members who may not see it;
• complying with all laws that apply to you and your community, including consumer, privacy, data-protection, tax, gambling, sweepstakes, and advertising laws, if you sell anything, run contests, collect Member information, promote products, or operate the Tavern for a business, organization, or public figure;
• any obligations you take on toward your Members, and any promises you make to them;
• the Bots and integrations you install and the data they collect, as described in Section 9.

Tavern Owners and Moderators are not employees, agents, contractors, or representatives of MEKASMITH, and may not present themselves as such.

A Tavern that is not adequately moderated, or that hosts, organizes, or tolerates violations of these Terms or the law, may be restricted, unlisted, locked, transferred, or deleted, and its Owner, Moderators, and responsible Members may be suspended or banned, with or without notice. We may act against a whole Tavern for the conduct of its Owner or Moderators, or where violating content is pervasive, even if some Members did nothing wrong. We may also preserve and disclose information about a Tavern and the accounts in it as described in Section 12. We are not liable to a Tavern Owner, Moderator, or Member for any of these actions, and no compensation is owed for a Tavern, role, or feature that is removed.

Ownership of a Tavern may be transferred only through the Service. If a Tavern Owner deletes their account or becomes unable to run a Tavern, we may transfer ownership to a Moderator, archive the Tavern, or delete it.

8. Wonders, Creators, and Wonders Studio

Wonders are created and published by users. The Creator of a Wonder is responsible for the Wonder and everything inside it: its content, code, assets, rules, items, purchases, maturity rating, and the way it treats the people who play it. A Creator must hold all rights needed to publish the Wonder and its assets, including assets imported into Wonders Studio or generated with the tools we provide, and must not publish anything that infringes another person's rights.

MEKASMITH is not the publisher of any Wonder. We may review, rate, feature, restrict, unpublish, or remove a Wonder at any time, including before it is published, and we may withhold or reverse earnings connected to a Wonder that violates these Terms or the law.

Wonders Studio and the platform tools are provided under the license in Section 5 and any additional terms shown when you enable a feature.

9. Bots, Integrations, and Developers

If you build or operate a Bot you are a developer, and you are responsible for your Bot: its behaviour, the content it posts, the data it accesses and how that data is used and protected, its compliance with these Terms and applicable law, and any promises you make to the people who use it. A Bot may access only the data it needs, may use that data only for the Bot's stated purpose, and must honour a user's or Tavern Owner's request to delete data collected from them.

If you install a Bot or integration in your Tavern, you are choosing to share the data that Bot can access with its developer, and you are responsible for that choice and for the Bot's activity in your Tavern. Bots built by third parties are not built, reviewed, or supported by MEKASMITH unless we say so, and we are not responsible for them.

We may revoke a Bot's access, rate-limit it, or remove it at any time.

10. Other People's Content and Conduct

Content posted by other users, Tavern Owners, Moderators, Creators, and developers is theirs. It does not reflect the views of MEKASMITH, and we do not endorse it or verify that it is accurate, safe, or lawful.

We work to make the Service a safe place and we prohibit objectionable content and abusive conduct, but we cannot guarantee that you will never encounter content or behaviour that you find objectionable, offensive, or harmful. To the extent permitted by law, we are not liable for the content or conduct of any user, Tavern, Wonder, or Bot, for any interaction between users, or for any harm resulting from them. If you see something that violates these Terms, report it as described in Section 12 and use the block and mute tools in the Service.

Links, media, and services provided by other users or third parties may take you outside the Service. We are not responsible for them.

11. Prohibited Conduct

You may not use the Service to create, upload, post, transmit, or distribute content, or engage in conduct, that:

• is illegal, unlawful, fraudulent, or deceptive;
• infringes intellectual property, privacy, publicity, or other rights;
• contains malware, exploits, or harmful code;
• threatens violence, or promotes terrorism, violent extremism, or criminal conduct;
• exploits, harms, endangers, or sexualizes minors in any way;
• is pornographic, sexually explicit, or otherwise inappropriate for the Service, or places mature content outside the controls designed for it;
• harasses, bullies, stalks, doxes, threatens, or abuses others;
• impersonates another person or entity, or misrepresents your affiliation with anyone, including MEKASMITH;
• invades privacy or discloses personal information without authorization;
• promotes hate, discrimination, or unlawful harassment based on a protected characteristic;
• promotes self-harm, or spreads misinformation that could cause real-world harm;
• sends spam, scams, unsolicited advertising, or engagement manipulation;
• attempts to cheat, exploit, bot, manipulate, or disrupt the platform or its systems, or evades a suspension, ban, block, or other enforcement action, including by creating another account or Tavern.

12. Community Guidelines, Moderation, Reporting, and Enforcement

The Community Guidelines are part of these Terms and explain in more detail what is and is not allowed. We have no tolerance for objectionable content or abusive users.

We may, but are not obliged to, monitor, review, filter, restrict, remove, disable access to, or refuse any User Content, Tavern, Wonder, Bot, or account when we reasonably believe it violates these Terms, the Community Guidelines, applicable law, platform or app-store rules, or community safety standards. We use automated filtering, including a profanity and objectionable-content filter, together with human review. We may act on a report, on our own initiative, or on a lawful request.

Every message, post, profile, and Wonder has a Report action, and every account can be blocked or muted. To report a whole Tavern, report its owner or a message in it, or email report@tav.gg, which also accepts any other report. We review reports of objectionable content and aim to act within 24 hours of receiving them, and when we find a violation we remove the content and remove or restrict the user who provided it. For immediate danger, contact local emergency services first.

Enforcement actions include warnings, content removal, feature limits, unlisting or locking a Tavern, unpublishing a Wonder, revoking a Bot, temporary suspension, permanent bans, and, where appropriate, referral to law enforcement. We consider context, severity, history, and the risk of continued harm. We may preserve and disclose User Content and account information where we believe in good faith that it is necessary to comply with law or a lawful request, to enforce these Terms, to respond to claims that content violates the rights of others, or to protect the rights, property, or safety of MEKASMITH, our users, or the public.

We may act on notices submitted under applicable intermediary-liability laws, including Japan's Information Distribution Platform Act (the Act on Dealing with Infringement of Rights and Other Issues Caused by Information Distribution via Specified Telecommunications). Where the law requires it, we will tell the person whose content was removed why, and how to appeal.

13. Copyright and Intellectual-Property Complaints

We respect the intellectual-property rights of others and expect users to do the same. Our designated agent for copyright notices is registered with the United States Copyright Office under the Digital Millennium Copyright Act (DMCA):

If you believe content on the Service infringes your copyright, trademark, or other intellectual-property right, send a notice to the designated agent above, by email to report@tav.gg with the subject "IP complaint", that includes:

• identification of the work you say is infringed;
• identification of the content you say is infringing, with a link, Tavern, Wonder, or other location so that we can find it;
• your name, address, telephone number, and email address;
• a statement that you believe in good faith that the use is not authorized by the rights holder, its agent, or the law;
• a statement, under penalty of perjury where that applies, that the information in the notice is accurate and that you are the rights holder or authorized to act for the rights holder;
• your physical or electronic signature.

We may remove or disable access to the content, notify the person who posted it, and give them an opportunity to respond with a counter-notice where the law provides for one. We may restore content in response to a valid counter-notice unless the complaining party informs us that it has sought a court order. Knowingly false notices or counter-notices may expose you to liability.

We terminate the accounts of repeat infringers in appropriate circumstances.

14. Appeals

You may appeal an enforcement action we take under these Terms or the Community Guidelines, including a suspension, ban, content removal, or an action against your Tavern, Wonder, or Bot, by following the Moderation Appeals process. We may uphold, modify, or reverse an action. Some details cannot be shared where doing so would expose another person's private information or undermine safety controls.

15. User Content License

You retain ownership of your User Content, subject to the rights you grant to us.

By submitting User Content to the Service, you grant MEKASMITH a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify only as technically necessary, display, perform, distribute, publish, moderate, and otherwise use that User Content solely for the purposes of:

• operating and providing the Service;
• making User Content available within the Service, including to the Members of a Tavern and the players of a Wonder;
• maintaining safety, moderation, and legal-compliance systems;
• improving, promoting, and supporting the Service.

By posting content in a Tavern or Wonder you also allow the other Members or players to view, react to, and share it within the Service as its features allow. Content you post in someone else's Tavern remains in that Tavern until it is deleted by you, by a Moderator, or by us, or until your account is deleted.

This license ends within a commercially reasonable time after the User Content is permanently removed from the Service, except to the extent retention is necessary for backups, legal obligations, dispute resolution, fraud prevention, or enforcement purposes.

16. Intellectual Property

The Service, including its software, systems, branding, artwork, design, logos, text, graphics, audiovisual materials, and underlying technology, is owned by or licensed to MEKASMITH and is protected by intellectual-property laws.

Except for the limited license granted above, no rights are transferred to you. "Taverns," "Wonders of Aether," "Wonders Studio," "MEKASMITH," and the associated logos are trademarks of MEKASMITH and may not be used without our written permission.

17. Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without restriction or compensation.

18. Account Deletion

You may request deletion of your account through:

• the Taverns app, where available; or
• support@tav.gg; or
• Account Settings on the website at https://tav.gg/app/settings?tab=profile.

Deletion may be subject to verification, security checks, and lawful retention requirements. Deleting your account ends this agreement, except for the sections that survive under Section 26.

19. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains what we collect and how we use it, and what Tavern Owners, Moderators, Creators, and Bot developers can see.

20. Third-Party Platforms and Services

The Service may be distributed through, or interact with, third-party platforms, app stores, sign-in providers, hosting providers, payment processors, streaming services, and other services. Those third parties have their own rules and terms that apply to your use of their services, and we are not responsible for them.

21. App Store Terms

If you download or use the Service through the Apple App Store or on an Apple device, the following also applies. These Terms are between you and MEKASMITH only, not Apple, and Apple is not responsible for the Service or its content. Your license is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. MEKASMITH, not Apple, is solely responsible for providing maintenance and support for the app; Apple has no obligation to provide any. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app, if any, to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. MEKASMITH, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product-liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy, or similar law. MEKASMITH, not Apple, is responsible for the investigation, defence, settlement, and discharge of any claim that the app or your use of it infringes a third party's intellectual-property rights. You represent that you are not located in a country subject to a United States government embargo or designated as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the app, such as your wireless data agreement. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of them Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

If you download or use the Service through Google Play, your download and any purchase made through Google Play are also subject to the Google Play Terms of Service.

22. Service Availability

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, to the extent permitted by law. We do not guarantee that the Service will always be available, uninterrupted, error-free, or secure, or that any User Content, Tavern, Wonder, or Bot will remain available.

23. Disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and uninterrupted availability.

We make no warranty about, and take no responsibility for, any User Content, any Tavern, Wonder, Bot, or community, the conduct of any user, Tavern Owner, Moderator, Creator, or developer, or anything you buy from, agree to with, or receive from another user.

24. Limitation of Liability

To the maximum extent permitted by law, MEKASMITH and its directors, officers, employees, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Service, any User Content, or the conduct of any user, Tavern, Wonder, or Bot, however caused.

To the maximum extent permitted by law, our total liability arising out of or related to the Service will not exceed the greater of:

• the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim; or
• JPY 10,000.

These limits do not apply to damages caused by our wilful misconduct or gross negligence, and nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection law where you live.

25. Indemnity

To the extent permitted by law, you agree to indemnify, defend, and hold harmless MEKASMITH and its affiliates, directors, officers, employees, agents, and service providers from and against all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from:

• your User Content;
• any Tavern, Wonder, Bot, or other community or content that you create, own, administer, moderate, publish, or operate, and anything that happens in it;
• your access to or use of the Service, or of any third-party service through it;
• your violation of these Terms or the Community Guidelines;
• your violation of any law or of the rights of another person;
• your negligence or wilful misconduct.

This indemnity does not apply to a consumer where it is prohibited by mandatory consumer-protection law.

26. Termination

You may stop using the Service at any time and may delete your account as described in Section 18.

We may suspend or terminate your access to all or part of the Service, or to any Tavern, Wonder, or Bot, at any time if:

• you violate these Terms or the Community Guidelines;
• your use creates legal, security, safety, or operational risk;
• we are required to do so by law, a court, or the rules of a platform or app store we distribute through;
• your account has been inactive for more than two years.

On termination your license to use the Service ends and we may delete your account and User Content, subject to the Privacy Policy. Sections that by their nature should survive termination will survive, including sections on user-content responsibility, licenses, intellectual property, disclaimers, liability limits, indemnity, governing law, and disputes.

27. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles.

Unless otherwise required by applicable law, the Tokyo District Court shall have exclusive jurisdiction in the first instance for disputes arising out of or relating to these Terms or the Service. If you are a consumer, you keep the protection of any mandatory law of the country where you live that cannot be excluded by agreement, and nothing in this section deprives you of a right to bring a claim in your own country where the law gives you that right.

28. Changes to These Terms

We may update these Terms from time to time. If we make a material change we will post the updated Terms and update the Effective Date above, and where the change is significant we will also give notice through the Service or by email before it takes effect. Continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms. If you do not agree, stop using the Service and delete your account.

29. General

• Entire agreement. These Terms, the Community Guidelines, the Privacy Policy, and any program or feature terms we present to you are the entire agreement between you and MEKASMITH about the Service.
• Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms. We may assign them to an affiliate or a successor in connection with a merger, acquisition, or sale of assets.
• Notices. We may give you notice through the Service, by email to the address on your account, or by posting on tav.gg. Notices to us go to the contact details in Section 30.
• Language. These Terms are written in English. Any translation is provided for convenience, and the English version controls to the extent permitted by law.
• Export. You must comply with export-control and sanctions laws that apply to you.
• No third-party beneficiaries. Except as stated in Section 21, these Terms create no rights for anyone other than you and MEKASMITH.
